Terms and conditions

1. Who we are and what these terms cover

These terms govern the purchase of data eSIMs on bidaiesim.com. The seller is Urko Cornejo Merodio, sole trader, Wilhelmstraße 27, 74072 Heilbronn, Germany, trading as Bidaiesim ("we"). Full details are in the legal notice.

We sell to consumers only, that is, to people buying for purposes outside any business or profession.

2. What we sell

A data-only eSIM for use in the destination you choose: it has no phone number, calls or SMS. Before you buy, each plan's page states the data allowance, the validity, the networks and, for daily plans, the reduced speed once the day's limit is used.

The eSIM is supplied by a wholesale provider and runs on local operators' networks. Traffic reaches the internet from the wholesale operator's country, so the IP address that websites and apps see may not be in the country you are in.

3. Compatibility

Before buying, you must check that your phone supports eSIM and is not locked to a carrier. Every destination page has a compatibility checker. If you buy for a phone that is not compatible and have not installed the eSIM, you can cancel it and we refund you (section 8).

4. How the contract is made

  • You choose a destination and a plan, and enter your email address.
  • You tick the immediate-delivery box (section 8).
  • You press the "Pay" button showing the amount. That click is a binding offer to buy.

The contract is made when we confirm the payment, which we confirm by email with an order summary. These terms are always available on this page, and you can save or print them.

The contract is made in the language you buy in: Spanish, English or Basque. The version of these terms in that language applies.

5. Prices and payment

All prices are final prices in euros. As a small business under § 19 of the German VAT Act (UStG), we do not charge VAT and therefore do not show it.

Payment is by card, Apple Pay or Google Pay through Stripe. We never see or store your card details.

6. Delivery

After payment we send you the eSIM by email (QR code and activation code), and it is available on your order's private page, usually in under a minute. If delivery is delayed, we tell you by email.

7. Validity and use

  • The plan starts with the first connection to a network at the destination, not when you buy or install it.
  • An eSIM is installed once, on one phone. If you delete it after installing, it may not be possible to recover it.
  • Validity and unused data expire at the end of the plan's period.
  • You can add data from your order page while the eSIM is active: a top-up adds data and validity to the same eSIM.

Fair use. The eSIM is for personal use while travelling. The provider may slow, suspend or terminate an eSIM in case of abusive use: sustained heavy use, use as a permanent local line rather than for a trip, resale, or use in routers, modems or IoT devices. If an eSIM is suspended for abusive use, no refund is given.

8. Right of withdrawal and refunds

As a consumer you have a statutory 14-day right of withdrawal, explained on the right of withdrawal page. When you pay, you tick this box:

"I agree the eSIM is delivered immediately and understand that I therefore lose the 14-day right of withdrawal."

In addition, as long as you have not installed the eSIM, you can cancel it from your order page and we refund the full amount. Once it is installed, write to us and we look at each case. The refund goes back to the card you paid with and usually takes 5 to 10 working days to appear, depending on your bank.

If we cannot deliver your eSIM, or a top-up fails, we refund the full amount.

9. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breach of an essential contractual obligation, meaning one whose fulfilment makes the contract possible and on which you may rely, and then only up to the foreseeable damage typical for this kind of contract.

The coverage, speed and availability of local operators' networks are outside our control.

10. Sanctions

We do not sell to, or for the benefit of, persons, entities or territories subject to sanctions of the European Union, the United Kingdom, the United States or Hong Kong. If an order breaches these restrictions, we may cancel it and refund the amount.

11. Customer service

Write to us by replying to any of our emails, at [email protected] or from the contact page. We reply by email within 12 hours.

12. Data protection

How we handle your data is set out in the privacy policy.

13. Applicable law and dispute resolution

German law applies. If you are a consumer, this does not deprive you of the protection given by the mandatory rules of the country where you have your habitual residence.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
